Article 117 report

Details

Article 138

Article 138 places a duty on the Secretary of State to carry out 3 reviews of specific aspects of UK REACH. These reviews look at:

  • whether to extend the requirement to complete Chemical Safety Assessments (CSA) and Reports (CSR) to registrants who produce substances in quantities of less than the 10 tonnes a year
  • the scope of Article 33 where suppliers must provide, and consumers may demand, information about substances of very high concern (SVHCs) in articles (as defined in the Review of Article 33)
  • the standard testing requirements for reproductive toxicity at lower tonnages

Article 117(4)

Article 117(4) places a duty on the Secretary of State, in co-operation with the devolved administrations, to publish a general report every 5 years on:

  • the experience acquired in the operation of UK REACH
  • the amount and distribution of funding made available by Defra for the development and evaluation of alternative test methods

This report is the first exercise of this duty. In carrying it out we have considered the experiences of government, regulators and stakeholders.

These reviews and reports fulfil our reporting duty.

The linked evaluation report fulfils the requirement of publishing the experiences acquired in the operation of UK REACH.
