Details

This regulatory position statement (RPS) does not change your legal requirement to take all reasonable steps to avoid contaminating other waste with persistent organic pollutants (POPs) when you collect, receive and store items of waste upholstered domestic seating:

  • at a HWRC
  • as part of bulky waste collected from households

However, the Environment Agency will not normally take enforcement action if you do not comply with this legal requirement when segregating waste upholstered domestic seating at a HWRC or as part of a bulky waste collection service from households if you meet the requirements in this RPS.

This regulatory position does not apply to any other legal requirements.

  1. We have amended the RPS to give more time to submit implementation plans, and to widen the scope of the RPS to include fly-tipped mixed bulky waste containing waste upholstered domestic seating.
