SIA taking victim impact statements

[This request follows on from a previous request: FOI 0397, ‘SIA enforcement actions in Belfast’]
A constituent has contacted our office raising concern that unfortunately, their partner was allegedly assaulted on 28 May 2022 at [redacted]. It has since transpired one of the individuals involved in the alleged assault has been alleged to be an unlicensed person working in licensable conduct. In such circumstances as these and when the SIA are investigating, would they consider taking a victim impact statement from the alleged assault victim and/or their next of kin?
2. Response
Allegations of assault are a matter for the police to investigate. However, given that the assault involves a potential unlicensed operative, this falls within our licensing regime. Upon intelligence about the unlicensed operative being reported to the SIA, it may be that offending under s.3 Private Security Industry Act 2001 is considered. However, this would also depend on factors such as the police investigation and any likely prosecution outcome. The sentencing guidelines for offences against the person are stronger than they are for s.3 PSIA matters which are summary only.
