Details

The Ministry of Justice has deposited a Statement in Parliament, pursuant to the European Union Act 2011. It concerns the agreement of a new multi-annual framework for the European Union’s Fundamental Rights Agency.

The European Union Act 2011 requires an Act of Parliament before a UK minister can support a European Union measure which has a legal base of Article 352 of the Treaty on the Functioning of the European Union (TFEU).

However, where the measure is equivalent to a measure previously adopted under Article 352 there is an exemption to this requirement under section 8(6) of the Act. In those cases a Statement may be laid in Parliament stating that in the opinion of the minister the decision relates only to an exempt purpose.

The decision to establish a multi-annual framework (2018 to 2022) for the Fundamental Rights Agency was brought forward under Article 352 TFEU and given that it is equivalent to the previous multi-annual framework for 2013 to 2017 a statement is being laid to that effect.
