Notice of the Secretary of State for International Trade decision to call in the Trade Remedies Authority’s (TRA) reconsideration of the UK’s steel safeguard measure

The Secretary of State for International Trade has today [22 March 2022] notified the TRA that she will be ‘calling in’ the TRA’s reconsideration of its recommendation made pursuant to regulation 51(1) of the Trade Remedies (Increase in Imports Causing Serious Injury to UK Producers) (EU Exit) Regulations 2019. This will allow the Secretary of State to in take responsibility for the reconsideration.
By exercising her call-in function, the Secretary of State is to decide whether to vary, maintain or revoke the measure, taking into account the TRA’s Report of Findings.
TRA’s recommendation on the steel safeguard measure
In June 2021, the TRA recommended extending the UK’s steel safeguard measure on 10 product categories for 3 years and revoking the measure on 9 product categories.
This recommendation was accepted by the Secretary of State for International Trade, who also provided for a 12-month extension of the current protections for 5 of the 9 product categories originally recommended for revocation to allow time for a reconsideration to take place.
On 7 September 2021, the TRA initiated their reconsideration on the following 14 categories:

Background
The TRA is the UK body that investigates whether trade remedy measures are needed to counter unfair trading practices and unforeseen surges of imports
The UK’s trade remedies regime is legislated for in the Taxation (Cross-border Trade) Act 2018 and the Trade Act 2021 and includes safeguard measures that address unforeseen surges of imports which injure, or threaten to injure, domestic producers.
Safeguards are one of the 3 types of trade remedies measures allowed by the World Trade Organization (WTO). The other 2 are anti-dumping measures, which counter ‘dumping’ (sale below the home market value); and countervailing measures, which address the effects of imports of subsidised goods.
The Secretary of State’s ability to decide in relation to a review or reconsideration of a transition trade remedy was legislated for in:
