On 9 August 2022 the Advocate General for Scotland submitted this written case to the Supreme Court (case no. 2022/0098), in relation to the reference by the Lord Advocate under paragraph 34 of schedule 6 to the Scotland Act 1998.

The full written case addresses preliminary issues as well as the substantive issue of competency.

The UK Government’s clear view is that a Bill legislating for a referendum on independence would be outside the legislative competence of the Scottish Parliament.

On October 5th the Advocate General for Scotland submitted a written response to the intervention by the Scottish National Party (SNP) on 21 September 2022.
