The Environment Agency has applied to the Secretary of State for Environment, Food and Rural Affairs for a licence.
The Environment Agency is giving notice of this application in accordance with Section 37 of the Water Resources Act 1991 and Paragraph 2 of Schedule 2 of the Water Resources (Abstraction and Impounding) Regulations 2006.
The application is for a transfer licence to abstract water from the River Lee Navigation at National Grid Reference (NGR) TL 37034 13382 to transfer it to the River Lee Navigation at NGR TL 37036 13388 and TL 37060 13358 without intervening use for the purpose of an eel pass.
The application is to abstract water as follows:
- 8 cubic metres an hour
- 173 cubic metres a day
- 63,245 cubic metres a year
- all year.
At a maximum instantaneous rate of 2.0 litres per second.
Further details of the proposal are: This application is linked with the Hardmead Gate impoundment licence, serial number TH/038/0007/007, issued in March 2022 for the Gate’s necessary replacement. The impoundment is a major flood control structure for the River Lee and the replacement includes an in-channel fish pass and the requirement for an eel pass. This application addresses the latter requirement with a re-designed pumped system, rather than gravity flow as originally proposed, to allow the free movement of eels upstream and downstream of the impoundment.

The licence shall be viewed as granted, unless the Secretary of State, either as a result of any representations made about the proposal or otherwise, instructs or asks for an application to be made to them.
