The Fowey Harbour Revision Order
On 23 August 2023, Fowey Harbour Commissioners (“the applicant”) made a formal application to the Marine Management Organisation (“the MMO”) under Section 14 of the Harbours Act 1964 for a Harbour Revision Order (“HRO”).

If made, the proposed HRO would modernise and consolidate the statutory harbour powers applying in relation to Fowey Harbour (“the Harbour”). The proposed order provides for the continued incorporation of the applicant with an updated constitution; clarity on the limits of the Harbour and the general functions of the applicant; provisions relating to the use of revenue, the establishment of a reserve fund and borrowing; provisions relating to charges; modernised powers of management and control of the Harbour to vest in the applicant including in relation to general directions, special directions and byelaws; the establishment of an advisory body or bodies consisting of stakeholders with which the applicant is required to consult on material matters; powers to vest in the applicant which include powers to develop or dispose of land, grant tenancies and for other commercial activities; powers to vest in the applicant relating to the delegation of functions, moorings, bunkering, aids to navigation, dredging, landing places, works, parking places, vehicles, wrecks, unserviceable vessels and obstructions; and provision for the licensing of boatmen and vessels and provision against danger to navigation.
To facilitate the above, article 70 of the proposed order revokes the enactments set out in Schedule 4 to the proposed order and amends the Order set out in article 69 of the proposed order.
The statutory 42-day public consultation on the HRO starts on 25 September 2024. The final date for consultation responses to be received is 5 November 2024. Any person desiring to make an objection or representation concerning the application should write to:

An objection or representation should:
- Be received before the expiry of a period of 42-days consultation period.
- Be made in writing and quoting reference HRO/2023/00002.
- State the grounds of the objection or representation.
- Indicate who is making the objection or representation; and
- Give an address to which correspondence relating to the objection or representation may be sent.
