Any lease that is granted to a resident after purchasing a share in their home through the Grenfell Assisted Home Ownership Scheme by their landlord must contain certain fundamental clauses.
These clauses are to ensure that the scheme’s policy aspects relating to the ongoing rights and responsibilities of the leaseholder and the landlord are enforced (the cap on rent and service charges, for example).
The model leases provide examples of how leases issued through the scheme might look and contain all of the fundamental clauses. There is a model lease for flats and a model lease for houses. The fundamental clauses are highlighted in blue in both model leases.
Solicitors acting for residents during their purchase of their share in their home must use these model leases as a reference point, to confirm that any lease sent to the household during conveyancing contains these fundamental clauses in full.
