The Port of Felixstowe Harbour Revision Order
On 13 September 2022, Felixstowe Dock and Railway Company (“the applicant”) made a formal application to the Marine Management Organisation (“MMO”) under Section 14 of the Harbours Act 1964 for a Harbour Revision Order (“HRO”).

If made, the proposed HRO would modernise and partially consolidate the statutory harbour powers applying in relation to the Port of Felixstowe (“the Port”). The proposed order provides for clarity on the limits of the Port; the establishment of an advisory body or bodies consisting of port stakeholders with which the applicant is required to consult on material matters; modernised powers of management and control of the Port to vest in the applicant including provisions relating to powers of general direction and special direction, navigational safety, conservation, bunkering, and the levying of charges; and powers to vest in the applicant which include the power to develop or dispose of land, and to grant tenancies.
To facilitate the above, article 43 of the proposed order revokes the Acts and Orders set out in Schedule 2 to the proposed order and amends the Acts and Orders set out in articles 40 to 42 of the proposed order.
The statutory 42-day public consultation on the HRO starts on 13 December 2023. As this 42-day consultation will run across 3 public holidays, the MMO is agreeable to consider consultation responses received up to 3 days beyond the 42-day consultation period. An objection or representation should:
Be received before the expiry of a period of 42-days consultation period.
Be made in writing and quoting reference HRO/2022/00009
State the grounds of the objection or representation.
Indicate who is making the objection or representation; and
Give an address to which correspondence relating to the objection or representation may be sent.
