The Yarmouth Harbour Revision Order

On 16 September 2022 Yarmouth (Isle of Wight) Harbour Commissioners (“the applicant”) made a formal application to the Marine Management Organisation (“the MMO”) under Section 14 of the Harbours Act 1964 for a Harbour Revision Order (“HRO”).

If made, the proposed HRO would modernise and consolidate the statutory harbour powers applying in relation to Yarmouth Harbour (“the Harbour”). The proposed order provides for modernised powers of management and control of the Harbour to vest in the applicant including provisions relating to powers to conduct commercial activities, become a member of a body corporate, delegate the applicant’s functions, charge interest on the Harbour’s capital, make investments, give guarantees, lend money, have electronic commissioner meetings, make charitable donations to the local community, dispose of wrecks, repair landing places, dredge, prevent the sailing of vessels, raise charges, recover charges and expenses as debts, exercise liens, remove vehicles from the Harbour’s land; the right for commissioners to be indemnified for any expenses they incur; and powers to vest in the applicant which include the power to borrow sums the applicant deems necessary, unlimited temporary borrowing, to develop or dispose of land, and to grant tenancies.

To facilitate the above, article 35 of the proposed order revokes the Acts and Orders set out in the Schedule to the proposed order and amends the Orders as set out in article 34 of the proposed order.

The statutory 42-day public consultation on the HRO starts on 24 January 2025. The final date for consultation responses to be received is 6 March 2025. Any person desiring to make an objection or representation concerning the application should write to:

An objection or representation should:

  • Be received before the expiry of a period of 42-days consultation period.
  • Be made in writing and quoting reference HRO/2022/00011
  • State the grounds of the objection or representation.
  • Indicate who is making the objection or representation; and
  • Give an address to which correspondence relating to the objection or representation may be sent.
