Each traffic commissioner is an appointee of the Secretary of State. The governance and delegations of functions, within the statutory and legal framework is therefore a matter for the traffic commissioners themselves.
Traffic commissioners operate at arm’s length from the Department for Transport as independent regulators and a specialist tribunal.
Traffic commissioners rely heavily on dedicated staff members who not only assist them but also carry out delegated functions on their behalf, understand the way that they work so that important lines of communication remain open and ensure that traffic commissioners remain sighted and engaged.
However, Traffic commissioners also rely on staff employed by the Department for Transport and its Agencies in delivering their statutory functions. The legal position can present challenges for those supporting traffic commissioners. The relationship with the Secretary of State, officials and departmental agencies is therefore set out in the Traffic Commissioner Framework Document.
