Tungsten electrodes from Laos, Thailand and India (anti-dumping duty 2382)

Overview

Initiating a circumvention investigation concerning anti-dumping duty on certain tungsten electrodes, consigned (directly or indirectly) from Laos, Thailand and India. Making these imports subject to registration.

The Commission has advised by Regulation (EU) No 2019/2171, OJ L329, that it is conducting a circumvention investigation into the transshipment of Chinese produced tungsten electrodes consigned from Laos, Thailand and India to avoid the anti-dumping measures which are currently in force on the product.

Customs authorities will register these imports for a period of 9 months from 20 December 2019.

This investigation may result in anti-dumping duty being applied retrospectively to imports during the registration period.

The product is described as:

  • imports of tungsten welding electrodes
  • including tungsten bars and rods for welding electrodes
  • containing 94% or more by weight of tungsten
  • other than those obtained simply by sintering
  • whether or not cut to length

This regulation takes effect from 20 December 2019.

The product is classified within commodity codes which have been introduced to incorporate the measure.

Exporters and producers may apply to the Commission to be exempted from the measures. If they meet the conditions imports from those producers may cease to be registered.

Due to the Commission’s late publication and application of the measures, it was not possible to update the Customs Handling of Import and Export Freight (CHIEF) system until 1 January 2020. Post clearance action may be required.
