Decision no 3/2021 of the United Kingdom of Great Britain and Northern Ireland and Japan Working Group on Wine on the forms to be used for certificates for the import of wine products originating in Japan into the United Kingdom of Great Britain and Northern Ireland.

The UK-Japan Working Group on Wine,

Having regard to the Agreement between the United Kingdom of Great Britain and Northern Ireland and Japan for a Comprehensive Economic Partnership (‘the Agreement’), and in particular Articles 2.27 and 2.34 thereof,

Whereas:

  1. The UK-Japan Working Group on Wine established in accordance with Article 23.4 of the Agreement is responsible, inter alia, for the effective implementation and operation of Section C of Chapter 2 and Annex 2-E of the Agreement.

  2. Pursuant to paragraph 1 of Article 2.27 of the Agreement, a certificate authenticated in conformity with the laws and regulations of Japan, including a self-certificate established by a producer authorised by competent authority of Japan, suffices as documentation serving as evidence that the requirements for the importation and sale in the United Kingdom of Great Britain and Northern Ireland of wine products originating in Japan referred to in Article 2.24, 2.25, or 2.26 of the Agreement have been fulfilled.

  3. Pursuant to subparagraph 2(a) of Article 2.27 of the Agreement, the forms to be used for certificates and the information to be provided on the certificates are to be adopted by the decision of the Working Group on Wine established pursuant to Article 23.4 of the Agreement.

  4. Pursuant to subparagraph 2(a) of Article 2.34 of the Agreement, the modalities concerning self-certification are to be adopted by the UK-Japan Working Group on Wine.

  5. Paragraphs 1 and 3 of Article 1 of the Decision no 1/2021, dated 1 January 2021, of the UK-Japan Working Group on Wine states that the form as set out in Annexes I and II of the decision no1/2019, dated 1 February 2019, of the EU-Japan Working Group on Wine established in accordance with paragraph 1 of the Article 22.4 of the Agreement between the European Union and Japan for an Economic Partnership may be used up to and including 30 September 2021 for wine products origination in Japan imported into Great Britain.

Has adopted this decision

Article 1

Paragraphs 1 and 3 of Article 1 of the Decision no 1/2021, dated 1 January 2021, of the UK-Japan Working Group on Wine shall be revised as provided for in Paragraphs 1 and 2 of Article 2 of this Decision respectively.

Article 2

  1. The form to be used for certificates authenticated in conformity with the laws and regulations of Japan from wine products originating in Japan imported into Great Britain is set out in Annex I to the Decision no 1/2021, dated 1 January 2021 of the UK-Japan Working Group on Wine. The form as set out in Annex I of the Decision no 1/2019, dated 1 February 2019, of the EU-Japan Working Group on Wine established in accordance with paragraph 1 of Article 22.4 of the Agreement between the European Union and Japan for an Economic Partnership may also be used for wine products origination into Great Britain.

  2. The form to be used for self-certificates established by producers authorised by the competent authority of Japan for wine products origination in Japan imported into Great Britain is set out in Annex II to the Decision no 1/2021, dated 1 January 2021 of the UK-Japan Working Group on Wine. The form as set out in Annex II of the Decision no 1/2019, dated 1 February 2019, of the EU-Japan Working Group on Wine established in accordance with paragraph 1 of Article 22.4 of the Agreement between the European Union and Japan for an Economic Partnership may also be used for wine products origination into Great Britain.

  3. The forms adopted by this Decision will be used from 1 October 2021.

Article 3

In cases where the United Kingdom of Great Britain and Northern Ireland intends to have adopted by decision of the UK-Japan Working Group on Wine a new form for certificates authenticated in conformity with the laws and regulations of Japan, or a new form of self-certificates established by producers authorised by the competent authority of Japan, for wine products originating in Japan imported into the United Kingdom of Great Britain and Northern Ireland, or to make any modifications to the forms adopted by the decisions of the UK-Japan Working Group on Wine, the United Kingdom of Great Britain and Northern Ireland will notify Japan of such intention no later than 90 days before the date on which the new or modified form is to be used.
