Updated rules and guidance for energy code modification appeals

The Competition and Markets Authority (CMA) is publishing updated procedural rules and guidance for energy code modification appeals.

The CMA has adopted updated rules and guidance for energy code modification appeals to the CMA to replace the prior rules (CC10) and guide (CC11).

The CMA consulted on the drafts of the updated rules and guidance earlier this year in our first consultation from 23 July 2024 to 3 September 2024 and again in our second consultation from 8 November 2024 to 22 November 2024.

The second consultation sought the views of interested parties on the CMA’s proposed changes to the draft updated Rules and Guide to take into account changes to the Energy Act 2004 introduced since the July consultation by the commencement of section 201 and Schedule 14 of the Energy Act 2023.

Respondents to the consultations included Ofgem, energy companies, and the energy system operator. Respondents welcomed the development of updated rules and guidance for energy code modification appeals.

Following the consultations, revisions were made to the updated rules and guidance. A summary of the responses we received to our consultations and our proposed approach for addressing those responses (including the revisions that we have made) is set out in the consultation response document.
