Personal information supplied to the Windrush Lessons Learned Review (‘the review’) by individuals or their legal representatives to help inform the review will be held and processed by the Review Team, which is based at 2 Marsham Street, London SW1P 4DF.

The Independent Adviser, to the review, is the data controller for the information being handled by the review and also acts as Data Protection Officer for the review. The Independent Adviser can be contacted by emailing Wendy.WilliamsWindrushIA@homeoffice.gov.uk.

How the review team may use your information

The review team is only allowed to process your personal data where there is a lawful basis for doing so under the UK’s General Data Protection Regulations (UK GDPR) and Data Protection Act 2018.

Any personal information you provide directly to the review under Article 6(1)(a) of the UK GDPR (‘consent’ based processing) will be used to help inform the Review team’s understanding of how policies operated by the Home Office have impacted on members of the Windrush generation and draw out lessons for the Department.

We may also share personal information you provide with the Home Office Windrush Taskforce or Home Office Windrush Compensation Team where you raise ongoing issues or questions of compensation that the Task Force or Compensation Team may be better placed to help resolve. In these circumstances, we will first request your consent to do so.

Personal information provided in this way will not be shared with Immigration Enforcement.

Under Article 6(1)(e) of the UK GDPR, personal information in the form of case files may also be passed to the Review team by the wider Home Office at the request of the Review to inform its work.

Storing your information

Your personal information which is provided to the Review for its work will be securely, retained and disposed of in accordance with the review’s Retention and Disposal Policy.

Requesting access to your personal data

You can request your personal information.

Under the UK GDPR you also have the right to object to and ask to restrict our use of your personal information, and to ask us to rectify or delete your personal information. However, there may be a number of legal or other official reasons why we need to continue to keep or use your data.
