Year 7 catch-up grant 2014 to 2015: conditions of grant

The Year 7 literacy and numeracy catch-up premium grant 2014 to 2015 will be paid under Section 14 of the Education Act 2002. In accordance with Section 16 of that Act, the Secretary of State lays down the following terms and conditions on which assistance is given in relation to this grant for the financial year beginning 1 April 2014.
1. Basis of allocation
The Year 7 catch-up premium allocations for 2014 to 2015 are based on £500 for each pupil as follows:
1.1 Pupils on the school census
- a year 7 pupil (or year group X and aged 11) recorded on the October 2014 school census and recorded in the 2014 key stage 2 assessment data as not having achieved level 4, 5 or 6 in reading or mathematics
1.2 Pupils on the alternative provision census
- a year 7 pupil (or year group X and aged 11) recorded on the January 2014 alternative provision census and recorded in the 2013 key stage 2 assessment data as not having achieved level 4, 5 or 6 in reading or mathematics
2. Allocations to local authorities and schools
Each local authority’s allocation covers schools that on 1 January 2015 were:
- maintained schools
- maintained special schools
- pupil referral units
- plus an allocation for alternative provision pupils
EFA allocations direct to schools cover schools that on 1 January 2015 were:
- academies
- free schools
- special academies
- special free schools
- alternative provision academies
- alternative provision free schools
- city technology colleges
- studio schools
- university technology colleges
3. Terms on which grant is allocated
The grant may be spent by maintained schools and academies for the purposes of the school; that is to say for the educational benefit of pupils registered at that school, or for the benefit of pupils registered at other maintained schools and academies; and on community facilities, for example services whose provision furthers any charitable purpose for the benefit of pupils at the school or their families, or people who live or work in the locality in which the school is situated.
The grant does not have to be completely spent by schools and academies in the financial year beginning 1 April 2014; some or all of it may be carried forward to future financial years.
The grant must be made available irrespective of the existence of any deficit relating to the expenditure of the school’s budget share. The year 7 catch-up premium is not part of school budget share and is not part of the individual schools budget. It is not to be counted for the purpose of calculating the minimum funding guarantee.
4. Pupils in alternative provision
The grant has also been allocated to each local authority for pupils in alternative provision where pupil attend schools (including non-maintained special schools) not maintained by the local authority for which the local authority pays full tuition fees. This include pupils educated otherwise than in schools under arrangements made by the local authority. This ensures there are funds to provide catch-up support for any year 7 pupils in alternative provision who did not achieve level 4 in reading and/or mathematics at the end of key stage 2.
5. Payment arrangements
The grant will be paid by the Secretary of State to local authorities on 27 February 2015. The payment will include allocations for all schools that are maintained schools on 1 January 2015, including schools that might convert to academy status after 1 January 2015. Schools that are academies or free schools on 1 January 2015 will be paid direct by the EFA on 2 March 2015.
6. Certification
Local authorities will be required to certify that they have passed on the correct amount of funding to schools or, where funding has been spent centrally, that it has been spent in line with the conditions of grant. The certificate will be issued to local authorities in April 2015 for completion and return to the EFA by 31 May 2015.
7. Variation
The basis for allocation of grant may be varied by the Secretary of State from those set out above.
8. Overpayments
Any overpayment of grant shall be repaid by the local authority or academy to the Secretary of State.
9. Further information
That the books and other documents and records relating to the recipient’s accounts shall be open to inspection by the Secretary of State and by the Comptroller and Auditor General. The Comptroller and Auditor General may, pursuant to Section 6 of the National Audit Act 1983, carry out examinations into the economy, efficiency and effectiveness with which the recipient has used its resources in discharging its grant-aided activities.
The grant recipient shall provide such further information as may be required by the Secretary of State for the purpose of determining whether it has complied with the conditions set out in this document. Other conditions
If the grant recipient fails to comply with the conditions set out in the paragraphs above, the Secretary of State may require the repayment of the whole or any part of the grant monies paid as may be determined by the Secretary of State and notified in writing to the grant recipient. Such sum as has been notified shall immediately become payable to the Secretary of State.
