CA90400 - Structures and buildings allowance (SBA): outline: qualifying activity - definition

For a building to be in qualifying use (CA92100), it must be used for the purpose of a qualifying activity.

SBA is only available as a deduction for a qualifying activity.  If there has not been any use for a qualifying activity during a chargeable period, there can be no entitlement to SBA (CA90100).

Qualifying activities for SBA are, to the extent that their profits or gains are, or (if there were any) would be, chargeable to tax in the UK, any of the following:

  • a trade (BIM20000)
  • a UK property business (CA90450)
  • an overseas property business (CA90450)
  • a profession or vocation (BIM14010)
  • the carrying on of a concern listed in ITTOIA05/S12(4) or CTA09/S39(4) (mines quarries and other concerns) (BIM15070)
  • managing the investments of a company with investment business (CA90450).
