CH194690 - Electronic sales suppression: penalty for making, supplying or promoting an electronic sales suppression tool: liability to penalties for multiple offences
The maximum cap of £50,000 applies to each penalty. For example, a person found liable for making, supplying and promoting a single tool could face a penalty of up to £150,000, that is £50,000 for making it, £50,000 for supplying it, and £50,000 for promoting it.
The maximum penalty also applies for each separate tool. For example, a person found liable for supplying two tools could face a penalty of up to £100,000.
This means that a person who made, supplied and promoted two tools would face maximum penalties of £300,000.
A person cannot be liable for a penalty for both
- possessing an electronic sales suppression tool, and
- for making and / or supplying an electronic sales suppression tool.
We cannot charge a person with a penalty for possessing, making, supplying or promoting an electronic sales suppression tool where that person has been convicted of a criminal offence in respect of that conduct.
