If a customer advises that they have been declared bankrupt, action will depend on the circumstances of the overpayment.
Official error/ overprovision of benefit

Recoverable overpayment
Determine
- the date of bankruptcy
- the court where bankruptcy was declared
- the bankruptcy reference number.
This information can be found at www.gov.uk/insolvency-service.
Check the date of the overpayment.
- If the overpayment decision was made after the date of bankruptcy, continue normal recovery action as per Insolvency Manual (INS2404).
- If the overpayment decision was made prior to the date of bankruptcy, refer case to the DMUW Enforcement Officer.
