The Court of Appeal decided in the case of Ridgeway Motors (Isleworth) Ltd v Altis Ltd [2004] EWHC 1843 (Ch) that the Limitation Act 1980 does not apply to judgments and therefore all the usual methods of enforcement may be used, even if 6 years have passed since judgment was entered. These include:
- charging orders
- third party debt orders
- attachment of earnings orders
- warrants of execution - but only with the permission of the court, see DMBM666830
- insolvency - action may still be commenced based on the county court judgment.
In addition you may consider the following, both of which are not enforcement actions but are steps to be taken to aid enforcement action:
- orders to obtain information, see DMBM666600
- judgment summons, see DMBM668020.
