Serving a claim

A claim form must be served within 4 months from the date of issue.

Cases issued clerically

The Civil Procedure Rules (CPR) provide for a claim to be served to the address shown on the N1 by either

  • personal service by the claimant
  • postal service by the court by first class post

The court will normally serve the claim unless you want to serve it yourself.

CCBC cases

The CCBC issues all claims by post.

Deemed date of service

The deemed date of service is the date the claim form is served on the defendant and depends on the method of service (see DMBM665390).
