DMBM675540 - Summary proceedings (Sc): How to apply to the court for a warrant to re-serve

Where there is insufficient time before the calling date to allow for re-service of thesummons you should send the summons (forms 1/1(b)) and the certificate of execution ofservice together with a completed (court) form 17 to the court. These should either besent using the Hays DX system (or by 1st class post if for whatever reason this is notpossible) or taken by hand to the court, if more convenient (DMBM675510).

You will not have to attend court on the calling date if you ensure that your applicationfor warrant to re-serve is notified to the court no later than two days before the callingdate.

The court will note its records and return the summons (forms 1/1b) to you showing newdates for the return day and the calling date.

As soon as you receive the return of the summons from the court you should proceed as fora new action.
