Some content of this manual is being considered for archiving. If there is content you use regularly, please email hmrcmanualsteam@hmrc.gov.uk to let us know as soon as possible.

Normally you will only have to appear in court when the defender has returned form 1b to the court advising of his intention to contest the claim.

In cases where the defender has not returned the form 1b to the court contending the claim you will not have to attend court on the preliminary hearing date provided that  no later than two days before the hearing date you have lodged (court)form 11 and returned the Certificate of Execution of Service to the sheriff court. The court will then grant decree automatically.

If you fail to take these actions however the case will be dismissed.
