DMBM681230 - Ordinary Cause: Recovering costs for cases where arrestments have been laid

Under the provisions of the Debtors (Scotland) Act 1987 (para 93) costs can only berecovered from the diligence to which they relate. This means that you can only recoverthe costs of each arrestment out of any funds caught for that arrestment (DMBM680090). Where you have lodged more than one arrestment but only one of them proves successful (inother words catches funds) you cannot recover the costs of the unsuccessful arrestmentsout of the funds caught for the successful one.
