IHTM12072A - Succession: Wills: Revocation of a Will: By subsequent Will or codicil (Scotland)

The Succession (Scotland) Act 2016 provides for modifications to the Succession (Scotland) Act 1964 in respect of revocation by the testator (IHTM12001) of a Will signed on or after 1 November 2016.

Where a Will is revoked, in whole or in part, by a subsequent Will signed on or after 1 November 2016, that earlier Will, or the revoked part of the earlier Will, is no longer automatically revived by the revocation of all or part of the subsequent Will.

This does not prevent the person who made the Will from reviving the Will by other means, such as re-executing it or making a new Will in the same terms as the one which was revoked.
