IEIM901620 - Reportable Sellers
Not all Active Sellers will be Reportable Sellers. A Reportable Seller is defined in the Model Rules as ‘any Active Seller, other than an Excluded Seller, that
- is resident in a Reportable Jurisdiction (see 901820), or
- provides Relevant Services for the rental of immoveable property located in a Reportable Jurisdiction, or
- is paid or credited Consideration in connection with Relevant Services for the rental of immoveable property located in a Reportable Jurisdiction,
as determined based on the due diligence procedures set out in Section II’
UK Reporting Platform Operators therefore have to determine whether each Active Seller is
- an Excluded Seller (see 901630), or
- resident in the UK or another Reportable Jurisdiction based on their primary address, or
- renting out a property in the UK or another Reportable Jurisdiction (or is paid or credited in respect of it) based on the address of the property.
If none of the criteria above is met, the Seller, although an Active Seller, will be outside the scope of the reporting rules.
This determination has to be made for every Active Seller for each Reportable Period so that the RPO knows which of their Sellers are specifically excluded from reporting, or are Reportable Sellers, or are completely outside the scope of the reporting rules.
