NMWM16300 - Disclosure of information: external solicitors acting for the Department for Business and Trade
The Secretary of State for the Department for Business and Trade (NMWM02020) may engage external solicitors in connection with the legal process they are taking forward in respect of a director’s disqualification, see (NMWM16280) and (NMWM16290).
Although, these external solicitors may be acting on behalf of the Secretary of State for Department for Business and Trade, there is no legal gateway to allow National Minimum Wage information to be passed to them without the appropriate consent as described in (NMWM16280).
An external solicitor may approach National Minimum Wage staff with a request for an interview and to obtain a formal statement. Whilst, National Minimum Wage staff may choose to comply with such a request if there is consent in place to allow HM Revenue & Customs (NMWM02030) to disclose information to the solicitor, there is no legal obligation for them to do so.
