Adopted EU recommendation GEN-036. UK approved recommendation on the use of product design licences.

Question

Companies X and Y have a licence agreement covering the design of a product. The UK type‐examination certificate has been issued by a UK Approved Body to company X for that product.

Is it possible for the company Y (licensee) to use the UK type‐examination certificate of the company X (licensor) to apply for production phase surveillance modules D, E or F?

Recommendation

No.

The licensee is the manufacturer responsible for the Approved Body’s production compliance verification, the issue of a Declaration of Conformity for their products and affixing the “Red Ensign” Mark of Conformity.

The licensee must apply for their own UK type‐examination certificate and must declare in writing to the Approved Body that they have secured appropriate rights of use pertaining to all drawings, test reports and other information submitted for the purpose of his application.
