Question
Which is the meaning of the phrasing “…have them carried out…” of Schedule 2, paragraph 5.2(c) of the Merchant Shipping (Marine Equipment) Regulations 2016 as amended?
Recommendation
The phrase “…have them carried out …” means that the UK Approved Body must ensure that the manufacturer arranges (or has arranged) the required test to be performed in order to allow the Approved Body to check that the requirements are met. The Approved Body is not responsible for carrying out the tests or contracting the tests with the laboratories.
