Law as a Tool: The Challenge of HIV/AIDS.

Abstract

This paper examines the link between development and international law (and this includes international law as reflected in national law). The key question posed here is, broadly, 'What role does (or could) international law play in development? Specifically, what role does (or could) human rights law (a major pillar of current international and national law) play in addressing the HIV/AIDS epidemic (a major development challenge particularly for many 'fragile' or 'crisis' states)?' The paper is a background paper for the 'International Law in Situations of Crisis and Breakdown' project.
