The CMA has published its interim response to the consultation and issued revised guidance for the Procedure for dealing with requests to carry out the test in Schedule 4 of the Groceries Market Investigation (Controlled Land) Order 2010.

Update on the CMA’s internally developed software tool
30 March 2021: In the CMA’s consultation response of 27 November 2020, we delayed the introduction of the CMA’s internally developed software tool and the proposed changes associated with the tool. In this response, we committed to provide an update on our plans regarding the tool by 31 March 2021.
The work on the CMA’s internal software tool is ongoing and our development team is still working to make sure that the issue previously identified is fully addressed. In light of this, we will continue to use the updated version of the ‘CLO Procedures Guidance’ which was published on 27 November 2020. This includes a number of proposed changes to the Test procedure which respondents were broadly supportive of. See our ‘Response to the consultation’ document, for further detail on the nature of these changes.
We will provide a further update on our plans for the tool and proposed associated changes once the development work is complete and it is possible to use the tool operationally within the CMA’s test procedures.

UPDATE: In light of the recent pressures facing parties most affected by the proposed changes in this consultation, we will be extending the consultation deadline by six weeks. The consultation will now run until Monday 8 June 2020.
The CMA is consulting on its procedures guidance document for dealing with requests to carry out the test in Schedule 4 to the Groceries (Controlled Land) Order 2010, as well as a number of changes to help improve the clarity of the test procedures. The CMA is seeking the views of all interested parties.
