Annual report on concurrency 2021

A report on the operation of the concurrency arrangements in the regulated sectors from 1 April 2020 to 31 March 2021.

In the regulated sectors, both the Competition and Markets Authority (CMA) and the relevant sector regulator have concurrent powers to apply competition law. These sectors account for around 25% of GDP and consist of the services we rely on - basic utilities like heat, light, broadband and water to financial services such as banking and insurance.

The annual concurrency report assesses the operation of the concurrency arrangements, as required by the Enterprise and Regulatory Reform Act 2013 (ERRA), during the preceding year. Concurrency has helped to increase the cooperation between the CMA and regulators, not just in relation to competition enforcement, but across other competition-related activities and tools – therefore increasing the effectiveness of our respective work across the board.

This is the seventh annual report produced by the CMA since the relevant requirements of the ERRA took effect on 1 April 2014. A ‘baseline report’ was published on 1 April 2014 against which future developments in the concurrency arrangements might be measured.
