In the regulated sectors, both the Competition and Markets Authority (CMA) and the relevant sector regulator have concurrent powers to apply competition law. These sectors account for around 25% of GDP and consist of the services we rely on - basic utilities like heat, light, broadband and water to financial services such as banking and insurance.

This year’s report is issued against the background of increasing concerns about the cost of living, following the economic shocks caused by the global COVID-19 pandemic and the invasion of Ukraine.

The annual concurrency report assesses the operation of the concurrency arrangements, as required by the Enterprise and Regulatory Reform Act 2013 (ERRA). During the preceding year. Concurrency has involved cooperation between the CMA and regulators, not just in relation to competition enforcement, but across other competition-related activities and tools – therefore increasing the effectiveness of our respective work across the board. This is all the more important in these difficult times to help ensure that essential services are working well for the millions of people who depend on them.

This is the eighth annual report produced by the CMA since the relevant requirements of the ERRA took effect on 1 April 2014. A ‘baseline report’ was published on 1 April 2014 against which future developments in the concurrency arrangements might be measured.
