1. Who is collecting your personal data?

The Controller of your personal data is the Department for Environment, Food and Rural Affairs (Defra).

Defra is committed to the responsible handling and security of personal data. Your privacy is important to us and protected in law through the General Data Protection Regulation (GDPR), the Data Protection Act 2018 (DPA 2018), and/or the Law Enforcement Directive.

2. What data are we collecting?

The personal data we collect includes:

  • your name
  • organisation (where applicable)
  • contact details such as your postal address, telephone number and email address

Information that may contain personal data includes the notice of appeal and further supporting evidence and documentation you provide as part of the appeal process. Further details on the additional information that will be requested can be found on GOV.UK

3. Why do we need your data?

This information will be used to conduct the appeal in accordance with the procedures as set out on GOV.UK, S.28 of the Wildlife and Countryside 1981 and The Sites of Special Scientific Interest (Appeals) Regulations 2009, as amended.

This includes sharing your personal data with Natural England (the other party), other interested parties (where applicable) and the Planning Inspectorate (the Inspector).

Please note, Natural England must make publicly available all papers they receive during the appeal, and all papers supplied by Natural England in relation to the appeal. This means that when Defra shares your personal data with Natural England the documents will subsequently be made publicly available. You should, therefore, not include personal data unless you are happy for it to be seen by others.

The Inspector will consider the appeal and submit a report based on the evidence for the Secretary of State who will make the final decision.

You can withdraw your appeal at any point up until the Secretary of State makes a decision on the case. Please confirm in writing to Defra and Natural England if you wish to withdraw your appeal.

Your personal data is being used on a consent basis.

5. Can you opt out?

You have the right to withdraw consent at any time, where processing is based on your consent. To withdraw consent please email us protected.areas@defra.gov.uk.

6. What will happen if you opt out?

If you opt out we will not share your personal data with Natural England, the Planning Inspectorate or other interested parties (if applicable). However if you withdraw consent this may impact the appeal proceedings.

7. What will we do with your data?

As set out above we will store and share your data with Natural England, the Planning Inspectorate and other interested parties where applicable.

We will not:

  • sell or rent your data to third parties
  • share your data with third parties for marketing purposes

We will share your data if we are required to do so by law - for example, by court order, or to prevent fraud or other crime.

8. How long will we keep your data?

We will only retain your personal data for the purposes of the appeal and for a period of 1 year following the appeal decision.

9. What are your rights?
