The government has committed to making it mandatory that property agents in the private rented sector holding client money obtain membership of a client money protection scheme. It is intended that these agents be required to obtain protection by 1 April 2019.
Client money protection schemes will be required to obtain approval from the Secretary of State. We have produced guidance for prospective client money protection schemes on the conditions for approval, the application process, and on-going requirements, including the provision of data to MHCLG for monitoring purposes
We have also produced an application form for prospective schemes to use. The guidance and application form were updated in December 2018 to reflect proposed changes to the client money protection legislative requirements. The updated versions of these publications are in draft form as the changes to the legislation are subject to parliamentary approval.
