This circular complements legislative amendments designed to improvide the efficiency and effectiveness of the planning appeals system. The guidance in this circular applies to appeals made and other proceedings initiated on, or after, 6 April 2009.
This circular revokes and replaces ‘Circular 08/93: Awards of Costs Incurred in Planning and Other (Including Compulsory Purchase Order) Proceedings’ and paragraphs 46, 48 and 49 of Part 1 of the ‘Memorandum to Circular 06/04: Compulsory Purchase and The Crichel Down Rules’.
The addendum published on 18 December 2012 provides additional guidance on the award of costs as it applies to statutory consultees, appeals on applications which are contrary to the local plan, the provision of true and accurate information, and timeliness in the planning process. The revised guidance in the addendum will apply to all appeals submitted under the Planning Acts in England submitted after the date of the publication.
