(a) These notes are not part of the Directions. They are intended to provide background and additional information.
(b) The Interpretation Act 1978 applies to these Directions. Therefore, all the definitions set out in the Registered Designs Act 1949 (as amended) and the Trade Marks Act 1994 (as amended) apply to these Directions. Further, amongst other things, generally any words importing the masculine gender include the feminine and words in the singular include the plural and words in the plural include the singular.
(c) Section 31A of the Registered Designs Act and Section 66 of the Trade Marks Act allow the registrar to give directions specifying any forms the use of which is required by the Registered Designs Rules or the Trade Mark Rules.
(d) The following designs and trade mark forms have been revised as set out below.
Form DF9A, Form DF29
(e) Form DF9A has been revised to replace the reference to the late renewal fee in section 5 with the following: “Amount of late renewal fee (if any). (If you are renewing up to six months after the renewal date.)”
(f) Form DF29 has been revised to remove the phrase “Official fee due with this form” from the top of the form.
(g) All of the UK Designs Forms (and information about associated fees) are available from our website.
Form TM9, Form TM9R, Form TM11, Form TM13
(h) Forms TM9 and TM9R have been revised to remove the reference to the fee from the top left corner of the first page. References to the fee and fee sheet have been removed from the checklist on page 2.
(i) Form TM11 has been revised to replace the description of the late renewal fee in section 7 with the following: “The relevant fee (if any) must be paid if you are renewing up to six months after the renewal date”.
(j) Form TM13 has been revised to remove the reference to the £100 restoration fee from section 6 and replace it with the following: “Relevant fee (if any)”. The £100 restoration fee has also been removed from the table in section 6.
