OPSS enforcement actions 1 October 2022 to 31 March 2023

The Office for Product Safety and Standards (OPSS) is part of the Department for Business and Trade, and exercises the powers of the Secretary of State in relation to a range of regulations. Our approach to addressing non-compliance by those we regulate, and potential product safety risks, is set out in our Enforcement Policy, which also sets out our approach to publishing details of our enforcement actions. Where enforcement action is taken in relation to an individual, details of that individual may be anonymised.

The enforcement actions listed below were taken by OPSS in the 6-month period between 1 October 2022 and 31 March 2023. Actions are grouped under the following headings: Construction Products, Product Safety, and Timber.

Construction Products – January 2023

Business: UNILIN INSULATION UK LTD

Action taken:

Two Prohibition Notices were served on 19 January 2023. Prohibition Notice 1 under Regulation 11(1) of the Construction Products Regulations 2013 applies in England, Wales and Scotland. Prohibition Notice 2 under Schedule 3, para 11(1) of the Construction Products (Amendment etc) (EU Exit) Regulations 2020 applies in Northern Ireland.

Product:

All Safe-R Pitched Roof and Soffit products covered by the Declaration of Performance dated 1 May 2018.

All Safe-R Framing Board and Rain Screen products covered by the Declaration of Performance dated 9 January 2019.

Breached regulation details:

Regulation 4 of the Construction Products Regulations 2013 in Great Britain.

Schedule 3, para 3 of the Construction Products (Amendment etc) (EU Exit) Regulations 2020 in Northern Ireland.

Detail:

The Notices prohibit the UK supply of the above affected products manufactured under AVCP system 3 by the business.

The business now has the correct AVCP system 1 to certify production processes.

Construction Products – February 2023

Business: UNILIN INSULATION UK LTD

Action taken:

Two Prohibition Notices were served on 1 February 2023. Prohibition Notice 1 under Regulation 11(1) of the Construction Products Regulations 2013 applies in England, Wales and Scotland. Prohibition Notice 2 under Schedule 3, para 11(1) of the Construction Products (Amendment etc) (EU Exit) Regulations 2020 applies in Northern Ireland.

All Safe-R Pitched Roof, Rainscreen, Framing Board, and Soffit products claiming Euroclass B supplied after 1 January 2023, covered by a Declaration of Performance indicating AVCP System 3 has been applied.
