OPSS enforcement actions 1 October 2023 to 31 March 2024

The Office for Product Safety and Standards (OPSS), the UK’s product regulator is part of the Department for Business and Trade, and exercises the powers of the Secretary of State in relation to a range of regulations. Our approach to addressing non-compliance by those we regulate, and potential product safety risks, is set out in our Enforcement Policy. This also sets out the approach we take to publishing details of enforcement actions.

The enforcement actions listed below were taken by OPSS during the 5-month period between 1 October 2023 to 31 March 2024. Actions are grouped under the following headings: Construction Products, Product Safety, and Timber.

Construction Products – March 2024

Business: UNILIN INSULATION UK LTD

Action taken:

Two Notices to Warn dated 8 March 2024. Notice to Warn 1 was served under Regulation 12 of the Construction Products Regulations 2013 applies in England, Wales and Scotland. Notice to Warn 2 was served under Schedule 3, paras 13 and 14 of the Construction Products (Amendment etc) (EU Exit) Regulations 2020 applies in Northern Ireland.

• All Safe-R Pitched Roof and Soffit products covered by the Declaration of Performance dated 1 May 2018.

• All Safe-R Framing Board and Rain Screen products covered by the Declaration of Performance dated 9 January 2019.

• All Safe-R Pitched Roof, Framing Board, Rain Screen and Soffit products covered by the Declaration of Performance dated 1 January 2023.

Breached regulation details:

Regulation 4 of the Construction Products Regulations 2013 in Great Britain.

Schedule 3, para 3 of the Construction Products (Amendment etc) (EU Exit) Regulations 2020 in Northern Ireland.

Detail:

The products were incorrectly assessed, and the classification of Euroclass B (Reaction to Fire) cannot be relied upon. In Reaction to Fire testing, some of the above products also failed to meet the Euroclass B Standard stated on the Declaration of Performance.

The business was required to send a Warning Notice to any person to whom the above products were provided, and those in the supply chain, distributors and final customers, where known.

The business demonstrated compliance with the Notice to the satisfaction of OPSS.
