Chapter 19 of the Care Act guidance has been updated to include the Department of Health’s position on the determination of questions of ordinary residence referred to the Secretary of State under section 40 of the Care Act 2014, following the Supreme Court judgment in the case of Cornwall Council v Secretary of State for Health and Others (Cornwall).
