University of the Arts London (“UAL”) | An admission that UAL failed to comply with Condition C1.1(a) – Arrangements with third parties, Condition A6.1 - Identification of risks and Condition H2 - Moderation where an assessment is marked by a Centre. | On 2 November 2018 Ofqual accepted an undertaking from UAL. | Closed |
Following an Ofqual audit programme that reviewed a group of awarding organisations’ arrangements for the management of Centre subcontracting to other third parties, we identified defects in UAL’s approach. Principally, we found that UAL did not ensure that the arrangements it establishes with third parties allow it to develop, deliver and award qualifications in accordance with the Conditions of Recognition or adequately monitor and, where appropriate, enforce its arrangements with Centres, in respect to their subcontracting activities. Also, UAL failed to have in place effective arrangements to undertake moderation of assessments carried out in its Centres. UAL accepted that it had breached our General Conditions of Recognition and gave Ofqual an undertaking to secure compliance with the Conditions. Ofqual did not find any evidence to suggest that there had been an adverse effect as a result of the defects.
Following the audit, UAL devised an action plan to address and resolve the non-compliances. In line with General Condition B8, UAL must now take all the steps identified in the undertaking. We may take further action if it does not follow through on its commitments.
Ofqual is satisfied that UAL has complied with the terms of the undertaking and the matter has now been closed.
