CBTM12009 - Guardian's Allowance: Claiming - Date of change of rate and duration of claim
Effective date of change of rate
Child Benefit & Guardian’s Allowance (Administration) Regulations 2003,regulation 14
Where a change in rate of Guardian’s Allowance would take effect on a day that is not the appropriate payday for the benefit or allowance, the change shall take effect from the following appropriate payday
Duration of claims and awards
Child Benefit & Guardian’s Allowance (Administration) Regulations 2003,regulation 15
A claim to Guardian’s Allowance is treated as made for, and awarded for, an indefinite period unless it would be inappropriate to do so, such as where a relevant change of circumstances is expected in the near future. In this event, the claim will be treated as made for a definite period appropriate to the circumstances, and the award will be made for that period.
Where benefit or allowance is awarded for periods after the date on which the claim is made that award is conditional on the claimant satisfying the entitlement conditions.
