CSLM8580 - Compliance: borrowers compliance: contentious appeals

Consequently, if evidence is required in a contentious appeal concerning whether a borrower was switched on but had not been switched off, or if a borrower otherwise challenges that he is liable to make Student and or Postgraduate Loan repayments, evidence can only be supplied by the Student Loans Company, or Secretary of State as appropriate, as a witness at the appeal hearing.

In most cases the liability to make repayments will not be in dispute, and
- You should be able to include this in an agreed statement of facts

- The required evidence, such as a copy of the switch on letter, can be obtained from the borrower using the regulation Schedule 36 information power
