Deciding whether to transfer the case

When a judgment debtor moves address within England and Wales after judgment, and the judgment debtor continues to pay or you wish to enforce by warrant of execution (the court will send the warrant to the judgment debtor’s home court) there is no need to transfer the case.

But where the judgment debtor does not continue to pay and you wish to enforce the judgment by any method other than warrant of execution, you will have to consider transferring the court action to the judgment debtor’s home court.

Transferring the court action

To transfer the court action you should

  • make application on form N244 to the court to transfer the case as appropriate.
