ECSH83225 - Sanctions for non-compliance: prohibition on management: issuing a prohibition on management

Once the decision-maker (DM) has identified that a prohibition on management is appropriate, the DM must issue a notice to the person under Regulation 83 of the Money Laundering Regulations 2017. This regulation specifies that the notice must contain:

  • HMRC’s decision
  • The terms and the duration of the prohibition on management
  • Clear written reasons for imposing the prohibition on management
  • The right to review of the decision under Regulation 94
  • The right to appeal a decision under Regulation 99
