IFM17340 - Condition C: Investors requesting information

Regulation 9A(6)(b) of SI 2006/964 and Regulation 75(4)(b) of SI 2009/3001 require that a person who falls within one of the intended categories of investors can, upon request to the manager of the fund, obtain information about the fund and acquire units in it.

This requirement is not incorporated into the QAHC regime (IFM40000+), NRCG rules (CG73995P+) and REIT rules (IFM21000+). This reflects the fact that funds seeking to satisfy the GDO condition for the purpose of those regimes may be marketed solely on the basis of the fund manager approaching investors.
