The Pubs Code Adjudicator (PCA) is pleased to confirm the Chartered Institute of Arbitrators (Ciarb) has secured the second extension to its contract for the provision of arbitration services on behalf of the PCA.

The Pubs Code Adjudicator (PCA) has issued the results of this year’s Annual Tied Tenants Survey, which highlight tenant sentiment towards, and their relationships with, the UK’s big six tied pub companies: Admiral, Greene King, Marston’s, Punch, Star Pubs & Bars, and Stonegate.

This is the account of a PCA staff member accompanying a Star Pubs & Bars Business Development Manager (BDM) to observe their day-to-day activities in the role.

Pubs Code Adjudicator (PCA) Levy Methodology for 2023-24

Section 63(1) of the Small Business, Enterprise and Employment Act 2015 (the Act) authorises the PCA to impose a levy on pub-owning businesses towards PCA’s expenses. Section 63(5) of the Act permits the PCA to vary the amount to be paid by pub-owning businesses, to reflect the expense and time that the PCA expects to spend in dealing with matters relating to them in the application of the Code. Before imposing the levy, the PCA must obtain the consent of the Secretary of State – section 63(2) of the Act.

What we do
The Pubs Code Adjudicator is responsible for enforcing the statutory Pubs Code. The Pubs Code regulates the relationship between all pub companies owning 500 or more tied pubs in England and Wales and their tied tenants.
PCA works with the Department for Business and Trade.

Referrals

There is a difference between a general enquiry and a formal referral to the PCA for arbitration. You can only make a referral if you are a tied tenant (or a pub owning business in relation to market rent only disputes), or authorised to act on their behalf.
